1. About This Policy
This policy lists what you must not do on ChekBuk, a product of Afria Technologies LLC ("we" or "us"). It covers our website, apps and every related service (the "Service"), including wallets, conversions, transfers, deposits, withdrawals, stablecoins, escrow and messaging.
It is part of our Terms of Service, and terms defined there mean the same here. Our licensed partners have their own rules, which we also apply. Something not listed here may still be banned by a partner or the law.
Who it covers. Every user, escrow participant (including invited non-users once they accept escrow terms) and delegate. If you act for someone else, you must make sure what you do for them follows this policy.
2. What You Must Not Do
Don't use the Service, directly or indirectly, for any of the following.
Sanctions.
- Using the Service if you are, act for, or are owned or controlled by someone on a sanctions list.
- Dealing with sanctioned people, entities or stablecoin addresses.
- Using the Service from, or for anyone located, organised or ordinarily resident in, a place we don't serve.
- Hiding your location or identity (VPNs, proxies, false addresses) to get around these rules.
We screen users, counterparties and stablecoin destination addresses against sanctions lists, including the US Office of Foreign Assets Control (OFAC) Specially Designated Nationals list, the UN Security Council consolidated list, the EU consolidated financial sanctions list and the UK consolidated sanctions list. We don't serve places under comprehensive sanctions, or other places our partners or our risk policy restrict. Where the Service is available is shown in the app.
Money laundering and terrorism.
- Moving, hiding or disguising criminal proceeds.
- Financing or supporting terrorism or terrorists.
- Splitting or structuring payments to avoid reporting, limits or reviews.
- Moving money for people whose identity or source of funds you don't know.
Fraud and scams.
- Any fraud or deception, including phishing, impersonation, romance, investment and advance-fee scams, fake invoices and fake listings.
- Using stolen, compromised or unauthorised cards, bank accounts, mobile money wallets or payment details.
- Making deposits you plan to charge back or dispute without good reason.
- Asking people to send money to "verify", "unlock" or "upgrade" an account.
Illegal goods and services. Paying for or selling anything illegal where you, the recipient or the transaction is, or helping any activity illegal under laws that apply to you, the other party, us or our partners.
Weapons. Buying or selling firearms, ammunition, firearm parts, explosives or other weapons, or related services, where the law or our partners ban it.
Drugs. Buying or selling illegal drugs, controlled substances, drug paraphernalia or substances made to mimic illegal drugs, or selling prescription-only medicines without a lawful prescription and licence.
Child abuse and exploitation. Anything involving child sexual abuse material or the sexual exploitation of minors, plus human trafficking, forced labour or the sexual exploitation of anyone. We report suspected child sexual abuse material to the authorities as the law requires.
Gambling. Running, paying or receiving money from gambling, betting, lotteries or games of chance, unless the operator is fully licensed and we approved it in advance (Section 3).
Unlicensed money services.
- Sending, receiving or holding money for others as a business, or acting as a payment service, money transmitter, remittance service, exchange or payment aggregator, without the required licences and our prior written approval.
- Offering currency or stablecoin exchange to others through your account.
- Reselling or giving others access to the Service.
Pyramid and Ponzi schemes. Pyramid, Ponzi and matrix schemes, "money multiplication" or "investment clubs" promising guaranteed returns, high-yield investment programmes, and any scheme paying earlier members with later members' money.
Unregistered investments. Offering, selling or promoting investments, securities, tokens or collective investment schemes that must be registered or licensed but aren't, or raising public money for investment without authorisation.
Escrow misuse.
- Sham escrows (with yourself, accounts you control or a colluding party) to move money, fake a history or claim a refund guarantee.
- Fake, altered or misleading evidence, documents, photos or delivery confirmations.
- Bad-faith disputes, or threatening disputes to extract money or concessions.
- Using a delegate to dodge identity checks, limits or principal confirmation.
- Using escrow for anything this policy bans. The Escrow Terms also apply.
Account and identity misuse.
- Opening an account in someone else's name, or using their identity, documents or selfie.
- Sharing your account, login details or devices, or using someone else's account.
- Having more than one personal account, or opening a new one after we closed or restricted yours, without permission.
- Buying, selling, renting or transferring accounts or chektags.
- Giving us or our partners false, incomplete or misleading information.
Getting around our controls. Dodging identity checks, sanctions screening, limits, holds, reviews or other controls; using several accounts, other people's accounts or structured payments to exceed limits; or hiding where money came from or goes.
Interfering with the platform.
- Scraping or harvesting data from the Service by automated means, including other users' information.
- Reverse engineering, decompiling or disassembling our software, except where the law expressly allows (see the EULA).
- Probing, scanning or testing our security, or breaking security or authentication, unless we approved it in writing. If you find a security issue, report it to support@chekbuk.com.
- Denial-of-service attacks, malware or overloading our systems.
- Exploiting bugs, pricing errors or rate errors for gain instead of reporting them.
- Using any interface but ours, or bots or scripts to create accounts or transactions.
Harassment and abuse.
- Using messages, attachments, payment notes, chektags or any feature to harass, threaten, abuse, defame or intimidate anyone.
- Sending hateful, violent or sexually explicit content, or content promoting violence or discrimination.
- Spam, unsolicited ads, or tiny payments used to deliver messages.
- Sharing others' private information without consent.
Intellectual property. Counterfeit goods; goods, services or content that infringe anyone's copyright, trademark, patent or other rights; or using the ChekBuk name, logo or marks without permission, including to suggest you are or are endorsed by ChekBuk.
3. Needs Our Approval
Some activities aren't banned but carry higher legal or financial risk. You can use the Service for them only with our written approval in advance (and our partners', where required). Approval may need extra verification, licences, documents and limits, and we can withdraw it. These include:
- licensed gambling, betting and gaming;
- licensed money services, remittance, currency exchange or digital asset services;
- crowdfunding, fundraising and charity collections;
- investment, lending and credit services;
- alcohol, tobacco, vaping products or regulated pharmaceuticals;
- travel agencies, ticket resale and timeshares;
- dating services and adult content;
- debt collection;
- precious metals, gemstones and high-value goods; and
- anything else our partners treat as restricted.
To ask for approval, or if you're not sure, contact support@chekbuk.com first.
4. Reporting Abuse
Seen a scam, fake escrow, harassment or a suspicious money request? Report it through in-app support, or email support@chekbuk.com with chektags, transaction or escrow references and screenshots. Send legal notices, including intellectual property complaints, to legal@chekbuk.com.
We review reports promptly but may not be able to share the outcome, for privacy or legal reasons. If you're a crime victim, also tell your local police. If someone got into your account, see the errors and fraud section of the Terms of Service.
5. If You Break It
If we reasonably believe you've broken this policy, the Terms of Service or the law, or that your activity puts you, other users, our partners or us at risk, we may, with or without notice where the law allows:
- refuse, delay, block or cancel a transaction;
- limit features, lower limits or freeze your account;
- hold funds while we investigate;
- reverse a transaction where technically and legally possible;
- settle an affected escrow under the Escrow Terms;
- ask for more information or documents;
- remove content, messages or attachments, or reclaim a chektag;
- close your account and any linked accounts; and
- recover losses, fees or chargebacks from your balance.
Some transactions, such as completed on-chain stablecoin transfers, can't be reversed.
Authorities. We may report activity to, and share information with, law enforcement, regulators, financial intelligence units and our partners, as the law requires or allows. If the law bars us from telling you about it, we won't.
Linked funds. Where the law requires, we or our partners may hold, block or surrender funds linked to banned activity, including sanctioned funds.
Your responsibility. Where the law allows, you're responsible for losses, fines, fees and costs that we, our partners or other users face because you broke this policy. See the indemnity in the Terms of Service.
6. Changes
We may update this policy as the law, partner rules or risks change. For a material change, we'll update the "Last Updated" date and give at least 30 days' notice by email or in the app, as the Terms of Service describe. Changes the law or partners require sooner may apply immediately.
